Terms of service
Last updated: 2026-10-05.
These terms are a contract between you and OpenWings Automação Comercial Ltda., CNPJ 63.852.648/0001-06 ("colding", "we") for the use of colding.app: the console, the API, the MCP server and the SDK.
1. The service
colding connects to email mailboxes you own, warms them up by exchanging mail with other customers' mailboxes, sends campaigns and single messages through them, and reads their inbox into one place. On a plan that includes it, it also sends your app's own email to one person at a time, such as a receipt or a sign-in link, from a mailbox you keep for that (transactional email).
We do not run mail servers, sending IP addresses or sending domains. Every message leaves through a mailbox you connected, from your provider, under your domain. Your provider's terms apply to that mailbox alongside these.
2. Accounts, workspaces and mailboxes
You need an account to use the service. Each account has one workspace, which holds the mailboxes, contacts, campaigns and plan. You, as its owner, are responsible for what its API keys do.
By connecting a mailbox you confirm that you own it or are authorised to operate it, and that its provider allows automated sending from it. Its credentials are sealed at rest and used only to send and read mail as the service describes. A provider that suspends or throttles a mailbox acts under its own terms; we surface it, we cannot reverse it.
Keep API keys secret; rotate one you suspect is exposed and tell us at [email protected].
3. Plans and payment
Each workspace has a plan with limits on connected mailboxes, sends per day, running campaigns, contacts and address checks per month. The engine enforces them, and the console tells you when you reach one.
The Free plan costs nothing. The paid plans and their prices are on the pricing page, and these rules apply to them:
- Payments go through Stripe. Subscriptions renew monthly until cancelled; cancelling keeps the plan until the end of the paid period. A failed renewal stops campaigns and the emails you send yourself until it goes through; warmup and inbox sync keep running.
- Paid periods are not refunded. We refund when the failure was ours (a period the service was unusable through our fault). We do not refund for mail that did not land, for a provider suspending a mailbox, or for results you did not like.
- Prices may change; we announce changes at least 30 days ahead and they apply from your next renewal.
4. Acceptable use
The Acceptable use policy is part of these terms. In short: mail people who have a reason to hear from you, from lists you can account for, with an opt-out in every message that you honour at once; no purchased or scraped lists, no consumer mail without consent where the law requires it, no spoofing, no phishing, no restricted categories, no abuse of the warmup pool, no circumventing the engine. We may suspend a workspace that breaches it, at once and without refund where the breach is deliberate.
5. Your data and your contacts
The contacts you import, the messages you write and the mail your mailboxes receive are yours. For that data we act as your processor under the LGPD and the GDPR: we process it only to run the service, on your instructions, and the Data processing agreement and the Privacy policy say how. You are the controller: you are responsible for having a lawful basis to hold and write to each contact, and for answering their requests.
An address that unsubscribes or is suppressed stays on your suppression list after the contact is deleted, because that is the only way to keep honouring the opt-out. If the whole workspace is erased, the opt-out of a recipient who asked to stop stays for 3 years, as a hash and not as an address, so the same owner's next workspace cannot write to them either.
6. No warranty about deliverability
We warm mailboxes, pace sends, check your domain's SPF, DKIM and DMARC records, and stop what should stop. We do not decide where mail lands. Providers change their filters, lists go stale, domains carry history we cannot see. We make no warranty that any message reaches an inbox, and no figure we show is a promise about the next send. We warrant only that we will show you honestly what the engine did and what it measured, and "no data" where it measured nothing.
You must not make decisions with legal or similarly significant effects on a person based on what the service reports about them.
7. Availability
We aim for the service to be available continuously, but it depends on your mail providers and on third parties we do not control. Planned maintenance is announced. Links in mail you already sent keep working while the sending service is down. No service credits are owed for downtime.
8. Intellectual property
The service, its software, its documentation and its brand are ours. Your content and your data are yours. Parts of the service are translated from warmbly (https://github.com/warmbly/warmbly), copyright Mindroot Ltd and the warmbly contributors, used under the Apache License 2.0.
9. Termination
A workspace's owner can ask to delete it at any time, in the console's Settings. After 30 days we erase it on our own; until that date the owner can cancel the request. From the moment they ask, the workspace sends nothing: its campaigns pause, its scheduled emails don't go out, warmup pauses, its API keys and pending invitations are revoked, and a paid plan stops renewing at the end of the paid period, which is not refunded. The Privacy policy says what happens to its data, including the few things that stay after the erasure and for how long. You can delete your own account at any time, in the console's Settings, after you give each workspace you own to another member or ask to delete it. The Privacy policy says what happens to your data then. We can suspend or terminate accounts that breach these terms or that we are legally required to close.
10. Liability
To the extent the law allows, our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect, consequential or lost-profit damages, including a provider suspending a mailbox or a domain losing reputation. Nothing here limits liability that cannot be limited by law.
11. Governing law
These terms are governed by the laws of Brazil, and disputes go to the courts of Curitiba, Paraná, without prejudice to consumer rights that apply where you live.
12. Changes
We may update these terms; material changes are announced by email at least 15 days before they apply. Continuing to use the service after that date is acceptance.
